Dr. Aafia Siddiqui, the mother of three children imprisoned in America, twenty years after her separation from her family, was given the opportunity to meet on May 31st. it was forbidden to hug or shake hands with the sister. Showing pictures or videos of children was also not allowed. Dressed in typical prison khaki clothes and a white scarf, her face with broken teeth from violence, the oppressed cursed Aafia cried out to be released from the hell of the prison. Unaware of the death of the mother and the disappearance of the little son, the daughter was agonized by the memory of the mother and the children.
Time will tell how long it will take to replace his longing with comfort. Dr. Fauzia Siddiqui, highly educated from the renowned American universities of Massachusetts and Brandeis, was abducted from Karachi in 2003 and went missing. In 2008, the press conference of British journalist Yvonne Ridley and Imran Khan revealed the secret imprisonment and atrocities of Dr. Aafia in Bagram prison, the American penitentiary in Afghanistan.
After that, Dr. Aafia was transferred to the United States in an injured condition on the charge of attempting to attack the American soldiers.
In 2010, he was sentenced to eighty-six years in prison without conviction in a manslaughter case. Dr. Aafia, a victim of oppression, abuse and violence by foreigners in the American prison, is always waiting for her help and release. For the release of Dr. Aafia, her sister, Dr. Fawzia Siddiqui, is continuously active in public with her supporters and human rights activists in the country and abroad.
A link to these efforts was the appearance of the case of Dr. Aafia Siddiqui in the Islamabad High Court on April 10. On this occasion, Clive Stafford Smith, a well-known social personality of human rights and the lawyer and special assistant of Dr. Aafia’s case, presented a detailed account of the physical and mental atrocities on Dr. Aafia. Mr. Clive is a leading international human rights lawyer behind the release of two Pakistani brothers (the Rabbani brothers) from Guantanamo Bay in February this year after twenty years.
The release of Dr. Aafia is their next target. According to Clive, he has represented many prisoners at Guantanamo Bay. None of them showed more patience than Dr. Aafia. He said that unfortunately, the record of physical and mental violence against Dr. Aafia Siddiqui was not presented before the American court hearing in the Aafia case.
According to him, if this record had been presented before the jury, no court could have put Dr. Aafia in jail. Mr. Smith also submitted a confidential note to the Hon’ble Court, in which he detailed what steps the Government of Pakistan could take to recover Dr. Aafia Siddiqui at the earliest.
He said that all these efforts will require continuous support from the government. In this regard, Clive Smith presented the possible means to the government of Pakistan to ensure the speedy recovery of Dr. Aafia. Appreciating the efforts of Clive Stafford Smith, the court directed the officials of the Ministry of External Affairs to take necessary steps in the Aafia case. The aforementioned court efforts proved to be a ray of hope and an American visa was issued to her sister to meet Dr. Aafia.
After twenty years, the two sisters met. The meeting with sanctions, despite being acrimonious, appears to be an important development in efforts to free Dr. Aafia. The long-standing protagonist of the Dr. Aafia case is PASBAN chairman Altaf Shakoor, whose continued tireless cooperation with Aafia’s family has kept the case not only alive but on the way to success.
Senator Mushtaq is determined to play an effective role with his political status. Advocate Clive Smith, an active member of international human rights, has stepped forward to release Aafia with his efforts and resources. Senator Talha Mehmood’s personal interest and efforts are also worth mentioning, due to which Dr. Aafia’s two children were rescued and delivered safely to their aunt, Dr. Fauzia Siddiqui. Similarly, there are some other kind people who kept raising their voices for Aafia’s release.
Former US Attorney General Ramsay Clarke, Congresswoman Cynthia McKinney, well-known author Sarah Flinders, well-known author and human rights pioneer Maury Salakhan and countless human rights activists from abroad.
According to Advocate Azhar Siddiqui, it is in the Pakistani constitution that Pakistani law applies to any Pakistani person in any country. The accused can be brought to Pakistan and tried according to law. Unfortunately, the most important thing regarding the return of Dr. Aafia Siddiqui is the lack of a relationship between Pakistan and America at the government level.
Similarly, a heavier responsibility is placed on the Government of Pakistan and the Ministry of Foreign Affairs. Foreign Minister Bilawal Bhutto has a compassionate request from the entire nation to patronize Dr. Aafia’s case.
Invite Dr. Fauzia to Islamabad and hold a press conference in front of international media. Let the world know about the efforts of your government. The second major responsibility currently rests on the PDM, which is headed by Prime Minister Shahbaz Sharif. There is a file of the Aafia release case on the desk of the said person.
Dr. Fauzia has also met, giving instructions to his subordinates to take the case forward. Honorable Prime Minister Shahbaz Sharif, Foreign Minister Bilawal Bhutto! امریکا میں مظلومانہ قید تین بچوں کی ماں ڈاکٹر عافیہ صدیقی کی اپنوں سے جدائی کے بیس سال بعد اکتیس مئی کو ملاقات کا موقع دے دیا گیا۔ دنیا کی اس انوکھی ملاقات کا احوال یہ کہ جیل کے ایک چھوٹے سے کمرے میں درمیان میں لگے موٹے شیشے کے آرپار فون پر گفتگو… بہن سے گلے ملنے یا ہاتھ ملانے کی پابندی تھی۔ بچوں کی تصاویر یا ویڈیوز دکھانے کی بھی اجازت نہ تھی۔
جیل کے مخصوص خاکی لباس اور سفید اسکارف زیب تن کیے، تشدد سے ٹوٹے دانتوں والے چہرے، مظلوم سراپے والی عافیہ جیل کے جہنم سے رہائی کی فریاد کرتی رہی۔ ماں کی وفات اور چھوٹے بیٹے کی گمشدگی سے بے خبر بیٹی، ماں اور بچوں کو یاد کرکے تڑپتی رہی۔ اس کی تڑپ کو آسودگی سے بدلنے میں ابھی اور کتنا عرصہ درکار ہے، یہ وقت بتائے گا۔
امریکا کی معروف جامعات میساچیوسٹس اور برینڈیز سے اعلیٰ تعلیم یافتہ، ڈاکٹر فوزیہ صدیقی کو 2003 میں کراچی سے اغوا کرکے لاپتا کردیا گیا۔ 2008 میں برطانوی صحافی ایوون ریڈلے اور عمران خان کی پریس کانفرنس میں افغانستان میں امریکی عقوبت خانے بگرام جیل میں ڈاکٹر عافیہ کی خفیہ قید اور مظالم کا انکشاف کیا گیا۔ اس کے بعد ڈاکٹر عافیہ کو امریکی فوجیوں پر حملے کی کوشش کے الزام میں زخمی حالت میں امریکا منتقل کیا گیا۔
2010 میں اقدام قتل کے مقدمے میں الزام ثابت ہوئے بغیر چھیاسی سال کی قید سنائی گئی۔ امریکی جیل میں غیروں کے ظلم، زیادتی، تشدد کا شکار ڈاکٹر عافیہ ہر دم اپنوں کی مدد اور رہائی کی منتظر ہے۔ ڈاکٹر عافیہ کی رہائی کےلیے ان کی بہن ڈاکٹر فوزیہ صدیقی ملک اور بیرونِ ملک اپنے حمایتیوں اور انسانی حقوق کے کارکنوں کے ساتھ عوامی سطح پر مسلسل سرگرم ہیں۔
ان کوششوں کی ایک کڑی 10 اپریل کو اسلام آباد ہائیکورٹ میں ڈاکٹر عافیہ صدیقی کے کیس کی پیشی تھی۔ اس موقع پر انسانی حقوق کی معروف سماجی شخصیت اور ڈاکٹر عافیہ کیس کے وکیل و خصوصی معاون کلائیو اسٹیفورڈ اسمتھ نے ڈاکٹر عافیہ پر ہونے والے جسمانی و ذہنی مظالم کا تفصیلی بیان پیش کیا۔ مسٹر کلائیو اس سال فروری میں دو پاکستانی بھائیوں (ربانی برادران) کی گوانتانامو بے سے بیس سال بعد رہائی کو ممکن بنانے والے عالمی انسانی حقوق کے معروف وکیل ہیں۔ ڈاکٹر عافیہ کی رہائی ان کا اگلا ہدف ہے۔
کلائیو کے مطابق وہ گوانتاناموبے جیل کے بہت سے قیدیوں کی نمائندگی کرچکے ہیں۔ ان میں سے کسی نے بھی ڈاکٹر عافیہ سے زیادہ صبر و استقامت کا مظاہرہ نہیں کیا۔ انہوں نے کہا کہ بدقسمتی سے ڈاکٹر عافیہ صدیقی پر ہونے والے جسمانی و ذہنی تشدد کے ریکارڈ کو عافیہ کیس کی سماعت کرنے والی امریکی عدالت کے سامنے پیش نہیں کیا گیا۔ ان کے مطابق اگر یہ ریکارڈ جیوری کے سامنے پیش کیا جاتا تو کوئی عدالت ڈاکٹر عافیہ کو جیل میں نہیں ڈال سکتی تھی۔ مسٹر اسمتھ نے معزز عدالت کو ایک خفیہ نوٹ بھی پیش کیا، جس میں انہوں نے تفصیل سے بتایا کہ حکومت پاکستان ڈاکٹر عافیہ صدیقی کی جلد از جلد بازیابی کےلیے کیا اقدامات کرسکتی ہے۔ انہوں نے کہا کہ ان تمام کوششوں کو حکومت کی مسلسل حمایت کی ضرورت ہوگی۔ اس ضمن میں کلائیو اسمتھ نے حکومت پاکستان کو ڈاکٹر عافیہ کی جلد از جلد بازیابی کو یقینی بنانے کے ممکنہ ذرائع پیش کیے۔
عدالت نے کلائیو اسٹیفورڈ اسمتھ کی کوششوں کو سراہتے ہوئے وزارت خارجہ کے حکام کو عافیہ کیس میں مطلوبہ اقدامات کرنے کی ہدایت کی۔ مذکورہ عدالتی کوششیں امید کی کرن ثابت ہوئیں اور ڈاکٹر عافیہ سے ملاقات کےلیے ان کی بہن کو امریکی ویزہ جاری کردیا گیا۔
بیس سال بعد دونوں بہنوں کی ملاقات عمل میں آئی۔ پابندیوں کے ساتھ یہ ملاقات تشنہ ہونے کے باوجود ڈاکٹر عافیہ کی رہائی کی کوششوں میں اہم پیش رفت معلوم ہوتی ہے۔ ڈاکٹر عافیہ کیس کے دیرینہ متحرک ترین کردار پاسبان کے چیئرمین الطاف شکور ہیں، جن کے عافیہ کی فیملی کے ساتھ مسلسل انتھک تعاون کی وجہ سے یہ کیس نہ صرف زندہ ہے بلکہ کامیابی کی جانب بڑھ رہا ہے۔ سنیٹر مشتاق اپنی سیاسی حیثیت کے ساتھ مؤثر کردار ادا کرنے کےلیے پرعزم ہیں۔ عالمی انسانی حقوق کے فعال رکن وکیل کلائیو اسمتھ اپنی کوششوں اور ذرائع کے ساتھ عافیہ رہائی کےلیے قدم بڑھا چکے ہیں۔ سینیٹر طلحہ محمود کی ذاتی دلچسپی اور کوششیں بھی قابل ذکر ہیں، جن کی وجہ ڈاکٹر عافیہ کے دو بچے بازیاب کروا کے ان کی خالہ ڈاکٹر فوزیہ صدیقی تک بحفاظت پہنچائے گئے۔ اسی طرح کچھ اور مہربان بھی ہیں جو عافیہ رہائی کےلیے آواز بلند کرتے رہے۔
بیرون ممالک سے سابق امریکی اٹارنی جنرل رمزے کلارک، کانگریس وومین سنتھیا مکینی، معروف مصنفہ سارہ فلنڈرس، معروف مصنف و انسانی حقوق کے علمبردار موری سلاخن اور اندورن و بیرون ملک انسانی حقوق کے لاتعداد کارکنان۔
ایڈوکیٹ اظہر صدیقی کے مطابق پاکستانی آئین میں ہے کہ کوئی پاکستانی فرد کسی بھی ملک میں ہو اس پر پاکستانی قانون کا اطلاق ہوتا ہے۔ ملزم کو پاکستان لاکر قانون کے مطابق ٹرائل کیا جاسکتا ہے۔ بدقسمتی ہے کہ ڈاکٹر عافیہ صدیقی کی وطن واپسی کے ضمن میں سب سے اہم چیز پاکستان اور امریکا کا حکومتی سطح پر تعلق کا نہ ہونا ہے۔
اسی طرح زیادہ بھاری ذمے داری حکومت پاکستان اور وزارت خارجہ پر عائد ہوتی ہے۔ وزیر خارجہ بلاول بھٹو سے پوری قوم کی جانب سے ہمدردانہ درخواست ہے کہ وہ ڈاکٹر عافیہ کیس کی سرپرستی کریں۔ ڈاکٹر فوزیہ کو اسلام آباد بلا کر عالمی ذرائع ابلاغ کے سامنے پریس کانفرنس کریں۔ اپنی حکومت کی جانب سے کی جانے والی کوششوں سے دنیا کو آگاہ کریں۔
دوسری اہم ذمے داری اس وقت پی ڈی ایم پر عائد ہوتی ہے جس کی سربراہی وزیرِاعظم شہباز شریف کے پاس ہے۔ موصوف کی میز پر عافیہ رہائی کیس کی فائل موجود ہے۔ ڈاکٹر فوزیہ سے ملاقاتیں بھی کرچکے ہیں، اپنے ماتحتوں کو کیس کو آگے بڑھانے کےلیے ہدایات بھی دیتے رہے ہیں۔
محترم وزیراعظم شہباز شریف صاحب، وزیر خارجہ بلاول بھٹو صاحب! مظلوم عافیہ کی رہائی کی کوششوں کو نتیجہ خیز بنانے کےلیے آپ کی ضرورت ہے۔ آنسو بھری اداس آنکھوں والی عافیہ کی فریاد ’’مجھے اس جہنم سے نکالو‘‘ آپ کے پیچھے ہے۔
